These General Terms and Conditions shall expressly regulate the commercial relationships arising between La Marihuela and Individual Users who, through the website www.lamarihuela.es (hereinafter, the "Website"), purchase the products that ESENCIA LOCAL S.L., hereinafter La Marihuela, with Tax ID B75547257 and administrative headquarters at Calle Río Jarama, 132. Ed. 4.03. Local Bajo C. Coworking In-Nova, 45007, Toledo, offers at any given time to Individual Users specifically for their online sale.

These General Terms and Conditions have been prepared in accordance with the provisions of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, and Law 7/1996, of January 15, on the Organization of Retail Trade.

La Marihuela may unilaterally modify, at any time it deems appropriate, the configuration and content of these General Terms and Conditions. However, the General Terms and Conditions applicable to a specific transaction shall be those in force at the time of its formalization.

The terms and conditions applicable to the purchase of Products offered for public sale by La Marihuela through its Website shall be all those described in these General Terms and Conditions and which will be detailed on the Website throughout the online purchase process. Through the use of the Website, users declare that they know and accept the different procedures necessary to access the different Products offered on the Website as well as to formalize their purchase.

IDENTIFICATION OF THE SELLER AND CUSTOMERS

In order to make purchases from the Website, it will be necessary for Customers to place their order by marking the product and quantity they wish to purchase.

PRODUCTS OFFERED

La Marihuela will publish, together with the image of each of the Products that are subject to sale through the Website, its description, as well as the applicable selling price.

The prices established on the Website will include the applicable VAT on each product as well as any other applicable tax.

The price of each Product does not include the shipping costs of the Product to the Customer's address. In any case, the shipping costs will be borne by the Customer, and this will be variable.

In the event that a specific Product is out of stock, La Marihuela will indicate this next to the product.

La Marihuela reserves the right to make modifications and updates to the products, prices, promotions and other conditions contained in www.lamarihuela.es.

At La Marihuela, we strive to ensure that the information offered on the website is truthful and appears without typographical errors. In the event that a typographical error occurs, beyond the control of La Marihuela, it will be immediately corrected. Should a customer decide to make a purchase based on such an error, the La Marihuela team will immediately inform them of such error, and both parties may rescind the purchase at no cost as long as the existence of such error is justified.

La Marihuela offers descriptions and photographs of the products offered on www.lamarihuela.es, however, the images are illustrative and in no way binding. La Marihuela reserves the right to make modifications to products, whether its own or those of third parties.

PURCHASE SYSTEM

The Customer must select the product(s) they wish to purchase and the quantity thereof. This operation must be viewed in "my account" and fill in the requested information.

The Customer will receive order confirmation which will be sent to the email address properly indicated by the Customer.

Payment of orders must be made via PayPal, credit card or bank transfer. The latter will only be possible if it is a domestic transfer within the Spanish State; otherwise, this payment method cannot be used.

PRODUCT DELIVERY

Once the Customer creates their account by providing the requested data or accesses their account if they have created it previously, they will immediately have access to the platform where they can access the purchased courses.

The delivery period is immediate except in the case of payment by bank transfer, since the order will not be processed until the amount is received, so access will not be granted until that moment, which may be delayed three or four days from the purchase.

DEFECTIVE PRODUCTS

If, once the order is received, the Customer observes that the product is defective or has any damage, the Customer may request the replacement of the Product. They must send an email to hola@lamarihuela.es explaining what happened, so they will be given the necessary instructions to access the new content, regardless of the responsibility established in article 123.1 of Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users. This communication must be made within no more than one week from receipt of the product.

In any case, the Customer has the right to withdraw from the order, provided that this is done within fourteen calendar days from when the product was received. In the case of digital products, no refund will be processed if the Customer has consumed more than 25% of the digital content made available to them. The refund of the amount, if applicable, will be made by the same means by which the payment was made.

B2C/B2B POLICY AND SUPPLY OF DOCUMENTATION

B2C Scope. Sales made through this website are retail to final consumers for personal/domestic use. Purchases intended for resale or for industrial or professional processes are not accepted through this channel. La Marihuela reserves the right to cancel or refund retail orders that, by their nature or volume, must be channeled through B2B.

B2B Channel (ESENCIA LOCAL). For professionals/companies we offer a specific channel with commercial conditions, professional formats and volumes, traceability and technical documentation (TDS, SDS/FDS, CoA, ECO/COSMOS certificates, etc.). Access requires prior registration and acceptance of B2B terms (including MOQ, delivery times and prices).

Technical documentation in B2C. In retail purchases (e.g., bottles of 10–30 ml of essential or vegetable oils), no TDS, SDS/FDS, CoA or ECO certificates are provided, as this is documentation for professional use. Instead, sufficient information is provided for safe use by the general public on the labeling and product sheet. In accordance with REACH art. 31.4, the SDS/FDS is not supplied to the general public if sufficient information is provided, except at the request of a professional user or distributor; labeling requirements are governed by CLP and, for cosmetics, by Regulation 1223/2009.

Safety and use. Some essential oils and aromatic materials may be classified for CLP purposes. The customer undertakes to follow the warnings and safe use instructions indicated on the labeling and product page, and not to use them in a way that requires licenses, authorizations or professional documentation through the B2C channel. For any professional use (formulation/commercialization), the B2B channel is mandatory. (Legal basis: REACH art. 31; CLP; Regulation 1223/2009).

APPLICABLE LEGISLATION AND JURISDICTION

Any conflicts that may arise from the application of these rules shall be governed by Spanish law and, to the maximum extent permitted by law, shall be subject to the Courts of Toledo.
